Katie Holmes Divorce Hearing, Actress talks about being in a 'new phase' of her life in upcoming magazine interview - conducted weeks before spilt announcement.Katie Holmes has denied reports she filed for an emergency custody and child support following news she is divorcing Tom Cruise.


Her lawyer released a statement today following claims she had asked a judge for an 'emergent application' which would have seen her come face to face with Tom for the first time since their split was announced five days ago.

Katie, 33, has asked for sole legal custody of their six year old daughter Suri.

But her lawer Jonathan Wolfe told People.com: 'Other than her action for divorce, the only pending application filed by Ms Holmes remains her request for an anonymous caption,' he said, referring to how she wants the papers in the case to be filed anonymously.

Cruise is yet to file any legal papers. The actor turned 50 yesterday and flew from Iceland where he is filming to Los Angeles, spending the occasion with his adopted children Isabella and Conner from his marriage to Nicole Kidman.

A source told People that he want to file papers in Los Angeles, which he considers his home, rather than in New York.

The insider said that despite having an apartment in New York, the family primarily spent time in the Big Apple for work purposes.

'They don't live in New York City. It's ridiculous.' the source is quoted as saying.

It was reported earlier that a hearing for the emergent application had been set for July 17, according to HollywoodLife.com.

A source allegedly told the website: 'Katie filed an ‘emergent application’ in New York City on July 3.'

Both of the Hollywood stars, who were married for almost six years, would be required to appear in court on the aforementioned date before Judge Matthew Cooper, HollywoodLife claimed.

The website claimed Katie’s attorney Allan Mayefsky filed for the custody and child support hearing yesterday.

Well-known legal analyst and author Lisa Bloom told website The Daily Beast: ‘She's making it clear she's going to play tough. Cruise is more of a high-profile celebrity than she is, so he has a greater distance to fall if grievances are aired.

‘Everyone has dirty laundry they don't want aired. She's saying play fair with me or else. Of course she would choose an experienced and tough lawyer.

‘But the fact that she'd choose someone who's been known to go to media in the past signals that she might have hired him for that reason.’

Katie's fears that daughter Suri was set to be inducted into a hardcore Scientology organisation were the driving force behind the end of her marriage to Hollywood star Tom Cruise.

The actress was allegedly convinced husband Tom Cruise was planning to send Suri, six, away to Sea Organisation - an association of Scientologists established in 1968 by L. Ron Hubbard, the science fiction writer and founder of Scientology.

Sea Org, as it is known, is where the highest levels of Scientology are taught and children as young as five can be sent to live there - without their parents.

Meanwhile, Katie refers to entering a 'new phase' in her life, adding, 'I know where I want to go,' in a interview set to be published in the July edition of Elle magazine.

The interview was conducted in May, just six weeks before last week's divorce announcement.

According to the New York Daily News, when asked about being in her 30s, the actress says: 'I definitely feel much more comfortable in my own skin.'

She goes on in the article: 'I feel sexier. I think in my 20s, it’s like you’re trying too hard to figure everything out . . . I’m starting to come into my own. It’s like a new phase.'

The newspaper reports a source as saying Katie did not gush about Tom at all during the interview.

Asked about her identity as Mrs Tom Cruise, she says. 'He has been Tom Cruise for 30 years. I know who I am and where I am and where I want to go, so I want to focus on that.'

The interview hits newsstands on July 17.
